Your estate

Estate Planning

Estate planning is the way to ensure that your assets pass to those you wish and that you appoint the appropriate decision makers to act on your behalf. Estate Planning is not just about making a will. We look at your assets and investments in a holistic manner and can advise you on ways to ensure that your assets are protected in case a beneficiary has a legal problem such as bankruptcy or a disability. Estate Planning will reduce the stress on your family and reduce the risk of potential claims against your estate.

Wills

A Will ensures that your assets are left to the beneficiaries or charities that you wish. Without a Will the Intestacy Act determines where your assets go and in what proportions. Your willable estate is made up of assets such as property, bank accounts, shares, etc. Usually, superannuation does not form part of your estate and therefore it is important to obtain advice about the difference between a binding or non-binding death benefit nomination.

Enduring Powers of Attorney

A Will comes into effect on your death. Your Attorney is a person you appoint to manage your financial affairs while you are alive but incapacitated due to, for example a stroke or dementia.

Enduring Guardians

If you want certainty about who can make decisions relating to your health, medical treatment, aged care and/or end of life decisions then you need to appoint an Enduring Guardian. If you do not appoint an Attorney or a Guardian while you have capacity, then the Guardianship & Administration Board may appoint an administrator such as the Public Trustee rather than a family member.

Estate Administration

We can assist you with the process of managing a deceased person’s assets. Administering an estate is often a complex matter particularly if the Executor of your Will is required to obtain a Grant of Probate. Where somebody dies without a will, this means they die “intestate”. In this case the next of kin may be required to obtain “Letters of Administration”. Our expert staff can assist and guide you through the process.
